Spark helps you keep track. You make the parking decision.
Check the actual signs, current restrictions and your saved spot. Data, detection and reminders can be wrong or late. Spark does not reserve parking, pay tickets or guarantee that a space is legal. Your non-waivable legal rights remain intact.
Using the service
By accepting these terms where presented, you agree to them. If you do not agree, do not register or use the service. You must have legal capacity to enter an agreement, or permission and supervision from a parent or guardian who accepts responsibility. The service is not for children under 13.
The initial app release is intended for United States users and NYC street-cleaning information. Access from elsewhere does not mean we support your location or its parking rules. Our Privacy Policy explains our information practices.
The App Store download is also subject to the license terms presented by Apple, including Apple’s Standard End User License Agreement when no custom app license applies. These service terms do not replace Apple’s required license or purchase terms, or your mandatory consumer rights.
Parking information has limits
Spark helps save a spot, interpret available street-cleaning data and schedule reminders. It does not provide a complete determination of whether you may park, stop or stand in a location. A displayed deadline, status, map, widget, calendar entry or Siri answer is information to help you, not permission to park or a promise of available space.
Restrictions can include meters, hydrants, driveways, bus stops, loading zones, temporary signs, construction, snow emergencies and other rules beyond street cleaning. A street-cleaning suspension does not suspend every other restriction. Posted signs, applicable law, current official notices and lawful directions from authorities govern.
Source data can be incomplete or out of date. GPS and curb-side selection can be inaccurate. You are responsible for checking the real location, street side, signs and rules, and for moving your vehicle when required. Spark is independent of the City of New York, NYC DOT, DSNY and other agencies. It is not a ticket insurer, reimbursement service or legal adviser.
See our parking guidance for practical checks and official information sources.
Reminders and safe use
Notifications, widgets, Siri, detection and shared-car updates may be delayed, stale, missing or incorrect. Their operation depends on permissions, location quality, network and provider availability, device power, iOS settings and background scheduling. A missing alert does not mean you can leave your car where it is. Use your own backup reminder when timing matters.
Do not read or operate the app while driving. Stop safely before checking the screen or changing a spot. Voice controls do not remove your obligation to drive attentively and follow traffic laws. Spark is not an emergency or safety-critical service.
Subscriptions, trials and refunds
Some features require Spark Pro. The Apple purchase screen shows the current price, billing period, included features, taxes where applicable and any eligible trial or introductory offer before you confirm. Website previews do not promise a particular price, trial or future feature.
App Store subscriptions renew automatically until canceled under Apple’s terms. A trial may convert to a paid subscription at the displayed price unless canceled in time. Follow the deadline shown by Apple; for a free or discounted trial, Apple advises canceling at least 24 hours before it ends if you do not want renewal.
Manage or cancel in iPhone Settings → your name → Subscriptions. Apple’s cancellation instructions explain the process. Deleting Spark, deleting an account or leaving a shared car does not cancel billing. Trial access may end when canceled; Apple displays the applicable access period.
Refund requests for App Store purchases go through Apple’s refund service and are subject to Apple’s policies and applicable law. Nothing here removes a refund or other remedy required by law. Price and renewal changes follow Apple’s notice and consent requirements.
Availability and previews
App Store availability will be announced on this website. Previews do not guarantee a launch date, admission to a beta, app approval, availability, pricing or a reserved subscription.
Demo screenshots use staged examples. Features may change before release. We aim to keep descriptions accurate; the actual offering and purchase screen govern what is available when you sign up or buy.
Permitted use and ownership
Subject to these terms and any applicable app license, you may use the service for your personal, lawful parking needs. Spark’s original branding, mascot, software and site content belong to us or our licensors. Public parking data remains subject to its source’s rights and terms.
Do not misuse accounts, impersonate others, collect another person’s location without permission, bypass access controls, interfere with the service, introduce harmful code or use automated access that harms availability. Restrictions on copying, resale or reverse engineering apply only to the extent permitted by law and do not override open-source licenses or legally protected activity.
You retain ownership of information you submit. You allow us to process and display it as needed to provide the features you request, including sharing it with your authorized car members.
Availability and changes
We may maintain, update or discontinue features, or restrict access reasonably necessary to address abuse, security risks, legal requirements or a material breach. Where practical and legally required, we provide notice and an opportunity to resolve the issue. We do not promise uninterrupted availability. Any rights concerning an existing paid subscription or prepaid service remain subject to applicable law and Apple’s terms.
External services and linked sites, including Apple and public data sources, operate under their own terms. Their availability and accuracy are outside our control.
Warranty disclaimer
To the fullest extent permitted by applicable law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that parking information is complete, correct or current, that an alert will arrive, or that use will prevent tickets or other losses.
Some jurisdictions do not allow certain warranty exclusions. In those cases, the exclusion applies only to the extent allowed, and statutory warranties and consumer protections continue to apply.
Limits on liability
Subject to the exceptions below and to the fullest extent permitted by law, Penguin Labs LLC, its members, employees and service providers are not responsible for parking tickets, fines, towing or impound charges resulting from reliance on the service, or for indirect, incidental, consequential, special or punitive damages, lost profits or lost data arising from the service.
Subject to those same exceptions, our total aggregate liability for claims arising from the service will not exceed the greater of US $100 or the amount you paid us for the service during the 12 months before the event giving rise to the claim. This limit applies regardless of the legal theory and only where enforceable.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer remedy that cannot lawfully be excluded or limited. They do not excuse our legal duties concerning privacy or security where the law prohibits such a limitation. If an exclusion or cap is not lawful for your claim, the applicable law governs instead.
Questions, disputes and updates
Contact Penguin Labs LLC at noticket.city@gmail.com if something goes wrong. We welcome the chance to resolve it. Contacting us is not a condition that prevents you from using a regulator, a court or a remedy available by law. These terms do not require arbitration or waive class-action rights.
Applicable law determines the law and courts available for a dispute. If one provision cannot be enforced, the remaining provisions continue to apply to the extent lawful. A failure to enforce a term once does not waive it in the future.
We may revise these terms and update the date above. We give notice of material changes and obtain renewed acceptance where required. Changes are not applied retroactively to an existing dispute. If you do not accept an update, you may stop using the service; existing payment and consumer rights remain intact.
